Terms of Use

By accessing or using this website or any related websites, landing pages, or digital properties operated by or on behalf of Box-n-Go, LLC (collectively, the “Site”), you agree to these Terms of Use. If you do not agree to these Terms, you should not use the Site. These Terms govern use of the Site only and are separate from any service contract you may sign with Box-n-Go for storage, moving, loading, or related services.

1. Scope of Application

These Terms apply to www.boxngo.com and all other websites, landing pages, and digital properties operated by or on behalf of Box-n-Go, LLC, including those operated under its dba names. These Terms govern use of the Site only and do not replace, modify, supplement, or control any separate agreements entered into for storage, moving, loading, or related services. If these Terms conflict with a separate service agreement, the separate service agreement controls for those services. Your use of the Site is also subject to our Privacy Policy and Cookie Policy.

2. Intended Jurisdiction and Audience

Box-n-Go’s services are intended for users located in the United States. We do not actively market or target our services to individuals outside the United States, and we operate primarily under U.S. and California law.

3. Who Operates This Site

This Site is operated by Box-n-Go, LLC dba Box-n-Go, Box-n-Go Storage & Moving, Box-n-Go U. Moving and loading services available through this Site are provided by Flat Fee Movers, Inc. (Cal T 0191190), operating as My Moving Guys and Helping Hands Loading Services, under separate agreements directly between you and those providers.

4. Third-Party Service Providers

Certain services available through this Site, including moving or loading services, are provided by Flat Fee Movers, Inc. under separate contracts directly between you and that provider. Box-n-Go, LLC is not responsible for the acts, omissions, errors, representations, warranties, or negligence of any such third-party provider, except to the extent required by applicable law. Any dispute relating to services provided by a third party must be resolved directly with that provider under the terms of your separate agreement.

5. Use of the Site

You agree to use the Site only for lawful purposes and not to interfere with its operation or attempt unauthorized access. We may restrict or terminate access at any time. The Site is intended for users 18 years of age or older. If you are under 18, you should use the Site only with the involvement of a parent or legal guardian.

6. Export Control and Sanctions Compliance

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to U.S. trade sanctions, and that you will not use this Site in violation of U.S. export control or sanctions laws.

7. No Professional Advice

Information on the Site is provided for general informational purposes only and is not intended as legal, accounting, financial, tax, or other professional advice. Downloading, printing, or copying material from the Site is for noncommercial, personal use only.

8. Electronic Transactions and Signatures

By accessing or using the Site, you consent to transact business electronically with Box-n-Go, LLC. You agree that electronic communications, records, contracts, and signatures (including those generated through quote requests, contact forms, online checkout, and other Site functions) satisfy any legal requirement that such communications, records, contracts, or signatures be in writing or signed, to the fullest extent permitted by the federal Electronic Signatures in Global and National Commerce Act (E-SIGN), the California Uniform Electronic Transactions Act (UETA), and other applicable laws.

9. User Content

The Site may include areas where you can submit reviews, comments, contact-form messages, or other content (“User Content”). By submitting User Content, you agree not to submit:

  • Sensitive personal information (health or medical information, Social Security numbers, financial account numbers, or similar data) unless we specifically request it;
  • Content that is unlawful, defamatory, obscene, harassing, threatening, fraudulent, or that invades privacy or publicity rights;
  • Content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right;
  • Content that impersonates any person or entity or misrepresents your identity or affiliation;
  • Spam, unsolicited advertising, promotional materials, or commercial solicitations;
  • Content that encourages or facilitates a criminal offense or violates any applicable law;
  • Viruses, malware, or other harmful code.

Box-n-Go does not control, take responsibility for, or assume liability for User Content. We may remove or disable any User Content at our discretion.

10. Notice at Collection

When you submit a quote request, contact form, exit-intent form, or create an account on this Site, we collect personal information as described in our Privacy Policy. By submitting information through the Site, you acknowledge that you have been provided notice of our data collection practices, including our use of cookies, analytics, advertising technologies, identity resolution technologies, and privacy request processes.

11. Intellectual Property

All content on the Site, including text, graphics, logos, images, data compilations, icons, and code, is owned by Box-n-Go, LLC or its licensors and is protected by United States and international copyright laws. The trademarks, logos, and service marks displayed on the Site (“Marks”) are the property of Box-n-Go, LLC or other parties. You may not use any Marks without prior written permission. You may not reproduce, distribute, modify, transmit, display, license, or create derivative works of any Site content for commercial or public purposes without our prior written approval. Personal, noncommercial use is permitted.

12. Copyright Infringement Notices (DMCA)

If you believe content on the Site infringes your copyright, you may submit a written notice to our designated agent containing all of the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
  2. A description of the copyrighted work claimed to have been infringed;
  3. A description of where the allegedly infringing material is located on the Site;
  4. Your address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

13. Third-Party Links

The Site may contain links to third-party websites. These links are provided for convenience only. Box-n-Go is not responsible for the content, products, services, or privacy practices of any third-party site.

14. Third-Party Embedded Content

The Site includes content and functionality provided by third parties, such as embedded video players and payment processing components. These components are controlled by their respective providers, who are responsible for their operation, security, accessibility, and applicable data practices. Box-n-Go does not control the code or interface of these components. Your interaction with embedded third-party content may also be subject to the terms and privacy policies of the applicable third-party provider.

15. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, Box-n-Go, LLC disclaims all such warranties.

16. Limitation of Liability

To the fullest extent permitted by law, Box-n-Go, LLC shall not be liable for indirect, incidental, special, consequential, or exemplary damages arising from use of the Site, reliance on Site content, interruption or security issues affecting the Site, or from the acts or omissions of any third-party service provider introduced through or in connection with the Site.

17. Indemnification

You agree to indemnify, defend, and hold harmless Box-n-Go, LLC, its affiliates, officers, directors, employees, and agents, from any claim, demand, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising from your use of the Site, your User Content, or your violation of these Terms.

18. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

18.1 Informal Resolution First

Before either party may commence arbitration, the party asserting a dispute shall first send the other a written Notice of Dispute describing the nature and basis of the dispute and the relief requested. Notices to Box-n-Go shall be sent by email to privacy@boxngo.com (or, if undeliverable, sales@boxngo.com) or by mail to Box-n-Go, LLC, Attn: Notice of Dispute, 6017 Randolph St., Commerce, CA 90040. The parties shall attempt in good faith to resolve the dispute within sixty (60) days after the Notice is received. If the dispute is not resolved within that period, either party may commence arbitration as set forth below. This informal resolution requirement is a condition precedent to filing any arbitration demand.

18.2 Agreement to Arbitrate

Except as provided in Sections 18.3 and 18.4, any dispute, claim, or controversy arising out of or relating to these Terms or your access to or use of the Site shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be seated in Los Angeles County, California, and may be conducted by videoconference or, where the AAA Consumer Arbitration Rules provide, by written submissions. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section 18.

18.3 Small-Claims Carve-Out

Either party may elect to bring an individual claim in small-claims court in Los Angeles County, California (or, if you are the claimant, the county of your residence) for any claim within that court’s jurisdiction, instead of arbitration.

18.4 Public Injunctive Relief

Nothing in this Section 18 waives, limits, or restricts either party’s right to seek public injunctive relief where California law provides that such right cannot be waived. If a claim for public injunctive relief is asserted, all other claims and requests for relief shall first be resolved in arbitration under this Section, and any claim for public injunctive relief shall be stayed pending completion of the arbitration.

18.5 Arbitration Fees and Costs

Payment of all AAA filing, administration, case-management, and arbitrator fees shall be allocated as provided in the AAA Consumer Arbitration Rules, under which Box-n-Go bears the substantial majority of such fees. Each party bears its own attorneys’ fees and costs except where applicable law provides otherwise.

18.6 Individual Claims Only; Class Action Waiver; Jury Waiver

All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, except as provided in Section 18.4. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. YOU AND BOX-N-GO EACH WAIVE ANY RIGHT TO A JURY TRIAL for all matters subject to this Section.

18.7 Mass Arbitration Procedures

If twenty-five (25) or more arbitration demands of a substantially similar nature are filed against Box-n-Go by or with the assistance of the same law firm or coordinated group of law firms, the parties agree that: (a) the demands shall be resolved in batches of no more than ten (10), with one batch proceeding at a time; (b) an initial set of up to ten (10) demands, half selected by claimants’ counsel and half by Box-n-Go, shall proceed to arbitration first as bellwether proceedings; (c) all other demands shall be held in abeyance, with applicable statutes of limitations tolled, and no AAA fees due on held demands, until the bellwether proceedings conclude; and (d) following the bellwether proceedings, the parties shall engage in a global mediation session before further batches proceed. If this Section 18.7 is found unenforceable as to any demand, that demand shall proceed individually under Section 18.2.

18.8 Severability of This Section

If any provision of this Section 18 other than Section 18.6’s class action waiver is found unenforceable, that provision shall be severed and the remainder of this Section shall remain in full force. If the class action waiver in Section 18.6 is found unenforceable as to a particular claim for damages, then that claim (and only that claim) shall proceed in court, and the remainder of this Section shall continue to apply to all other claims.

18.9 Survival

This Section 18 survives any termination of these Terms or of your use of the Site.

19. Governing Law

These Terms apply regardless of where you access the Site. All disputes shall be governed by and construed exclusively under the laws of the State of California, without regard to conflict-of-law principles.

20. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severable from these Terms and shall not affect the validity or enforceability of the remaining provisions.

22. Changes to These Terms

We may update these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.

24. Telephone Call Monitoring and Recording

Telephone calls between you and Box-n-Go, both inbound and outbound, may be monitored and recorded for quality assurance, customer service, employee training, security, and other lawful business purposes. By calling Box-n-Go or accepting a call from Box-n-Go, you consent to such monitoring and recording. Where required by California or other applicable law, you will also be notified of recording at the start of the call. If you do not consent to call recording, please end the call and contact us in writing instead.

25. Credit Card and Payment Information Security

Box-n-Go uses industry-standard encryption (256-bit SSL/TLS) to protect credit card and payment information submitted through this Site. Payment data is processed through PCI-DSS-compliant payment processors. If you prefer not to submit payment information online, you may complete your transaction by phone at 877-269-6461.

26. Accuracy of Information

Information on this Site is believed to be accurate and current at the time of posting. Box-n-Go reserves the right to modify, update, or remove information from the Site at any time without notice. Continued use of the Site after changes constitutes acceptance of the updated content.
